The will of William W. Jackson is recorded in Upshur Co., WV Will BKA:31-34 as follows:

 

I William W. Jackson of the County of Upshur being of sound and disposing mind and body do make this to be my last will and testament as follows which is to say

1st I desire that my body be "decently" buried and my funeral expenses and just debts paid as soon as "practitable" out of the funds herein after name and provided for that purpose

2nd I devise into my wife Lucy S. Jackson the House and Lot on which I now reside bounded as follows Beginning at a Stake Standing on the River Bank between the river and the turnpike corner of H.O. Middleton and running thence up said river with its meanders toward the Mill to a Stake on the river bank thence crossing the S&P Turnpike at right angles from said Stake so as to pass the house now occupied by Thomas S. Russell on the West side therof about 9 ft. from said house and continuing said line northwardly to the river and across said River to my line thence with said line up said River to Stake mine and H.O.  Middleton's corner thence with the line between mine and H.O. Middleton's lands Southwardly to the Beginning with its appurtenances in fee simple to her and her heirs forever.  I also give and bequeath into my said wife Lucy S. Jackson three cows and three hogs which I now own and all my household and kitchen furniture of every description as her own exclusive property to be dispose of as she may see fit excepting one Bed and 30 yds of woolen carpets for John M.A. Jackson as herein after provided and I also give and bequeath unto my said wife Lucy S. one half of the clear profits arising my my Mills and Machine from the time of my death - until the same one sold by my Executor as herein after provided.  Also the growing crop I now have in the ground 3rd I give and bequeath to John M.A. Jackson one Bed and Bedding and 30 yards of "wollen" carpeting which my wife Lucy S. is to furnish to him when he come of the age of 21 years or married out of those I now own the said Bed to consist of one Straw bed 2 feather beds (one heavy and one light) 2 blankets 2 sheets 2 pillows and 4 cases for same.  one Bolster and 2 cases for same 2 double coverlets, 2 good quilts of comfort 1 white worked Counterpane 4th I devise my Real estate lying at the mouth of the Buckhannon River for which I hold from separate title bonds for four separate pieces of land all adjoining each other.  One containing 60 1\2 acres which I purchased from E.N. Wells and embraced in the title bond marked A - another containing about 17 acres which I purchased from henry KCrites by title bond marked C another aontaining 180 square Rods which I purchased from Joh M. Crousea (?) by title bond marked D and the 4th containing about 5 1\2 acres which I purchased from Abraham Reger by title bond - marked E also one mill site condemned thereon and I devise my executor to deliver said title bond to said John M.A. Jackson and William H. Trask after my death so that the deeds can be made to them.  I devise them to take immediate possession of said land after my death I also give and bequeath unto the said John M.A. Jackson and William H. Trask my turning Lathe and Turning tools both for Iron and Wood, together with a lot of circular and Setting saws one mandral for circular saws and boxing and I also give to the said John M.A. Jackson and William H. Trask one old carding machine 1 set of main cylinder and doffer cards that I now have on hand but they shall ___consideration of said machine and cards be charged with the amount of one execution levied thereon in favor of Bastable Hauseldon for the use of Bastable amounting to upwards of Forty dollars.  5thly I devise and hereby authorize and impower my executor herein afer named to collect all outstanding debts due to me and to sell all my other real and personal estate not herein before devised or disposed of either at public or private sale and upon such credit as he may deem most advantageous to my estate not exceeding, 1,2 and3years in the sale of my real estate excepting my Mill property at Sutton in Braxton Co., VA which he may sell upon a credit of 1,2, 3 and 4 years if he thinks it advisable but in all Sales shall take bond with approved personal security and "m" the sale of real estate, shall also retain a lien thereon to secure the payments of the purchase money and make and execute such conveyances of said real estate as long may be necessary and out o the first proceeds of sale of my real and personal estate to be sold as foresaid and out of the proceeds of the outstanding debts due to me (when collected)  I desire my funeral expenses and all my just debts to be paid off and satisfied, first paying two dollars to the Minister who may preach my funeral sermon.  6th and out of the residue of the proceeds of such sales and collection, remaining after the payments of funeral expenses and debts - I desire two hundred dollars to be expended on the execution of Mason work and tombstones to be placed at and over my grave and the grave of my first wife Charlotte Jackson and a Marble Slab to be contracted and placed over each grave upon the top of the Mason work as a covering to the grave and proper inscriptions thereon, and twenty five dollars more to be applied as my wife may direct in placing tombstones and around her daughter Mary Ella Parrack's grave, and I desire one hundred and fifty dollars of said balance to be applied to the education of the said John M.A. Jackson if the said sum is not expended in that way before the said John M. A. attains the age of 21 years or married the said sum or the balance thereof not so expended shall be paid over to him to be disposed of by him as he may see proper.  7th After allowing my executor a liberal compensation for his services the residue of my estate proceeds thereof not already devised or bequeathed and remaining after the satisfaction of the divisees, legacies, debts, appropriations and charges aforesaid I desire to be divided as follows to wit to my wife Lucy S so much tereof as to make one half of such balance were the said House and Lot (divised to "here" as aforesaid) treated apart of said balance to be equally divided between my two Brothers - Jacob J. Jackson, George R. Jackson, My sister Rebecca and John M.A. Jackson.  8th It is my will and desire that "m" all disputes and controversies concerning claims or debts due to or from me on conveying the title to on boundaries of my real estate my executor shall compromise or arbitrate the same to avoid litigation if possible or practicable and prudent in his opinion Opinion to which end I hereby give him full power and authorize, but in dispute or controversies concerning my real estate now but - men of legal knowledge shall be chosen as arbitrators.  9thly It is my will and desire that all my devisees and legatees aforesaid shall so far as convenient assist in carrying out - my desires or at least place no obstructions in th way of their consumation and it is farther my will and desire that if anyone of my said legatee or devisees shall by use of any power he may possess obstruct and prevent, the executor of this my last will and testament in part or in whole he shall forfeit whatever may be devised or bequeathed to him herein,which devise or bequeath shall thereon fall to my wife Lucy S. Jackson and I do hereby nominate and appoint my brother George R. Jackson to be my executor of this My last will and testament and I hereby revoke and make void all formes or other wills or wills made by me and do hereby declare thes presents to be and contain my last will and testament.  In witness whereof I the said William W. Jackson have to this My last will and testament set my hand and seal this 24th day of June in the year 1858.  WW Jackson

Note:  William H. Trask, one of the devisees is listed as William H. Trask in printed 1850 Lewis Co., Census, age 21 listed as a carpenter in the household of William W. Jackson..  1880 Upshur Co. Census lists William H. Trask age 49.

 

 George R. Jackson was the administrator of Wm. W. Jackson's will.  John S. Fisher became the administrator after George's death.   The account shows that George R. Jackson, executor for Wm. W. Jackson, sold on the 20th Sept., 1858 at public auction the Buckhannon Mills to Jacob J. Jackson for $6550. (See Lewis Co., WV Chancery Case 1860 drawer A-G Permelia F. Jackson vs. John C.
