                        Will of Edward H. Jackson

 

I Edward H. Jackson of the County of Lewis in the State of Virginia being of sound mind conscious that it, is destined for all men once to die, have hereby thought proper to make a disposition of such estate as it hath pleased, God, to help me with in this world in the manner following to wit.  1st it tis my will and desire and I do hereby devise to my beloved wife Rebeckah Jackson for and during her natural life the following tract of land situate in the County of Lewis Sate afore-said it being apart of the house farm where I now live on.  Beginning as follows at the mouth of George Carpers lane on the line in the middle of the Big road West of the dwelling house running thence in the middle of P. road.

Easterly to the first drain after passing a cabin called the school house thence a Southerly direction to a white oak tree with bane slots mortised in it.  At this time thence a strait lain Easterly to the mouth of the Spring drain on the Buckhannon river none by the Wm Casto's Spring thence by the Wm. White Springs, thence down the Buckhannon river with its meanders to a Gum tre none by the White Cotton corner, thence with that line to or near the hed of paint run on the top of hil to a white oak, thence 68 W 124 poles to a white oak.  WhiteCottons Beginning corner, thence S 85W 42 poles to a stone put in by George Carper and self, thence S 19 E. on the lain between sd Carper & me to the Beginning the above tract will be lain of in three parts one for Wm. L. Jackson, Edw. N.B.Jackson & one for Minter J. Jackson which will fully sho what I do desire to nec? as tho it stood between the second and third lain or so long as she remains to be my widow   2nd by it tis my will and desire and I do hereby desire to my sd wife Rebeckah all the house hole and Kitchen Furniture Beding & C.  Except the stove & grate to have and to hold during her natural life out of which my sd wife is to prudence& Rebeckah, an - Edward Newton Barnes Jackson.  My Daughter & son bedding, household to make them equal to the rest of any, thing left of the above described property in this devise of the property after dividing as desired in this devise not to be sold shall be for my sd wife's benefit and at her controle during her natural life, if anything should be found left at my sd wifes deth it shall be sold by the Executor at twelve months____by giving good security to secure the debts and by equally devided between my daughters.  3rd by it is my will and desire and I do hereby devise the gras run land to John G. Jackson my son which he is in possession of & all that may be found against the said J.G. Jackson to have and to hold forever.  I heare refer to the title book charge made against said J.G. Jackson of six hundred and twenty six dollars & fourteen cents and in adition to this it tis by desire that my said son J.G. J. shall have two hundred dollars out  of the home place or as I my herafter direct.  4th by it is my will and desire and I do hearby desire the uper end of the home farm it being part of Castro Tract & apart James Malcom conveyed to me as follows.  Beginning in the middle of the Big road the Corner I boun my wife to down the road on her loins to the same Spring drain. thence up the River with its meanders to Casto"s Corner thence with its loins to a White Oak but down but down on the Casto line running between the Gasper Laurentz and the Casto tracts 8th degres to it being the corner James Malcom conveyed to me N81W22 poles to a stake with stones round it thence with George Carpers and my loin to the road to Beginning to my son Minter Joseph Jackson to have possession at my deth and it tis my further will and desire that my son Minter J. Jackson at the deth of my wife take position of the aditional land none by the flat & river field as followas running from the Corner maid at the first drain in the big road. thence a straight loin to the lower ege of a Big rock none by the rabit rock clost by the fence inside of the field cold the flat at the first drain running under the rock and through the fence crossing the road from the lower ege of P..rock with the fence to Buckhannon River to reach two flat from sd fence on the s. side to the river about forty four poles above the mouth of Stoney run thence up the river to the Spring dean referred to in the first devise to take position at any time after my wife is no more an weidde.  5th it is my will and desire and I do hereby devise that my son Minter J. Jackson shall at the time of being able to take ful position shall pay five hundred dollars, two hundred dollars to sd J.G. Jackson fifty dollars down, fifty dollars at the end of every year until paid up and three hundred dollars to my daughters Margaret H. Hinkel, Sarah Ann Sexton and Mary Strader, Winford E. Miller and Prudence Jackson and Rebeckah An Jackson six children fifty dollars each which shall be paid in four years from sd. M.J. Jackson position of the additional land each.  One equal portion untill it tis all paid if sd. Minter should fail to pay it tis my desir that the Executor or Executrise rent the land until the Money is paid out of sd. rents.  6th it tis my will and desire and I do hereby desire that my son William L. Jackson shall have the lower end of the tract of land devised to my wife as follows. beginning one and one half rods below the mouth of Stony run keaping that distance from sd. run up to the second drain on the No. side none by the loin lot drain thence with the fence now. Mow? to the big road reaching to the middle of sd. road to the barn lot drain thence a strait loin to a red Oak Settin clost to the Spring, at the lower end of the Snake hollow or so fare on this loin to make fifty acres of land. then corner and run as square as conveniant sutes the land on the No. of the said fifty acres to the loine between George Carper and __being the loine of the White Cotton tract from the river to the top of the hill at the hed of paint? run commencing at sd loine and running with sd. loin to the Gum thence up the river to the beginning.  My son Wm L. Jackson shall take position of the above fifty acres of land as soon as my wife shall sease to be my widdow by giving up my note of twenty five dollars.  Executed to sd Wm. L. Jackson and paing seventy five dollars to be equally divided between my daughters Margaret H. and Sarah Ann and Mary and Elizabeth and Prudence and Rebeckah and Winford E__ 7th It tis my will and desire and I do hearby devise to my son Edward Newton Barnes Jackson all the balance of the land devsed to my wife except what is devised to Minter Joseph Jackson and William L. Jackson to have possession as soon as my wife shall seas to be my widdow at the time my son Edw B. Jackson as his duly appointed gardian shall pay five hundred dollars to be equally divided and paid to my said daughters Margaret H._and Margaret Elizabeth and Winford E. and Prudence and Rebeckah on as follows.  One hundred every year each instalment to be equally divided between the sd girls and if the money cant be raised it shall be raised by renting the land untill the sum is paid then sd E.B. Jackson shall hold the land with its apertains as thereon forever.  8th It tis my will and desire and I do hereby devise to my daughter Elizabeth Archer the two lots No. 3&4 which the dwelling hous is on and to comence at the South East Corner of lot No 3 thence to Jacob J. Jackson's line thence with sd Jacksons loin to -hanell Farnsworths line thence with said Farnsworths line to the north west corner of lot No 4 thence with the big road to the sout west corner of lot No 3 thence No75 to the beginning together with the house hole & kitchen furniture beds and bedding and taning tools and the stock in the tanyard north____ and all that I have got.  B.B. Archer contract in riting not.  Cold stalk and of improvements that I have maid and the land I __at two hundred dollars I devise to Elizabeth to have and to hold her natural life and then to her children forever.  It shall be understood that in running to J.J. Jacksons loine from south E. Corner of lot No 3 thence to a __ __ oak the South E. Corner of Tanyard lot thence to square of sd. J.J.J. towit loine as to form _to a stake or stone thence with sd J.J. Jackson' loine No 4?3 and 1/2 West thence as above stated round to the beginning of it tis my will and desire and I do hereby devise to my daughters Margaret Hadden Hinkel to be alowed forty five dollars less in this devise than Sarah. An Sexton and Mary Strader and Winford Elenor Miller and Prudence Rebeckah An Jackson the outlands one tract in the County of Gilmer 9 or 8 hundred acres.  One in Barbor County Va two hundred acres and one tract of land of one thousand acres in Randolph County a tract of land on Jaw bone run and a tract on the west side of Buckhanon river Below the mouth of Cutrights run the above lands shale be disposed of at my deth or as soon as arrangements can be made after as follows to be sold at a credit one half to be paid in twelve months after such saile the other half in twenty four months by holding a laine? on the lands until the purchase money is paid it tis my will and desire that quit claim deads be maid. 10 It tis my will and desire and and I do hereby desire that Prudence and Rebeckah A. Jackson shall each of them have one horse, cothe___briddle, Martin __lls and saddel and one cow each amounting to one hundred and fifty dollars each including their clothes and bedding  ____the rest of the children has ___will show on the little book of charges, the first setting out so as to make all start eaven with small exceptions and this property shall be suported of the farm and if it showded die before the others shall marry or go to themselves or self such property shall be kept up to her out of the funds raised by the sales of property or as the increase of stalk? from the farm untill such marriages or untill they or her shall arrive to full age.  11th It is my will and desire and I do hereby devise to my son Edward Newton Barnes Jackson one horse creature, one cow, clothes & c to the amount of one hundred and fifty dollars to have possession of the above amount at his marage or when he arrives to full age to make him equal with the rest of my children as shown by the little book.  12th It tis my will and desire and I do hereby devise that the cooking stove and grait and all the moveable property that may be found on the farm out side doors when I die shall be sold except one cast plow to Brake up ground one yoke of work oxen three horse creaters four milk cows the flock of sheep large or small.  Many or few ox cart sled two pair gears two ox yokes bar shears, plow, shovel plow, Iron tooth, Harrow iron pickfork one cattle bell, fifteen two year old stear cattle at twelve months credit to create a fund to pay my debts should there not be a sufficiencey of money on hand and coming to pay the debts. the above property named that is to be sold shall be aplied and taking to pay the debts and if any left it shall be equally divided between my daughters Margaret H. Sarah A. Mary Winford E. Prudence Rebeckah or in all cases bonds with security will be taking to secure the debts.

13th It tis my will and desire and I do hereby devise that all the property in second and eleventh devise which is named not to be sold shall belong to my wife to carry on the farm and support her and the children and School the children that may be on the farm so long as she may live or remain my widdow if my wife should marry she shall have fifty follars a year after such marrage so long as she may live. should not be living when Edw B. Jackson shall arrive at full age then the Edw B. Jackson shall pay five hundred dollars more to the five hundred dollars named in the seventh devise and if my wife should live until Edw B. Jackson shall arrive to the age of thirty years then Edw B. Jackson shall pay only two  hundred and fifty dollars the above five hundred dollars as it my be shall be equally divided between Margaret H. Sarah An. Mary Winford E. Prudence Rebeckah An in instalments of one hundred dollars a year until paid up one hundred dollars to be equally divided between my sd daughters above named or as I may arain_? hereafter 14th I. tis my will and desire I do heareby devise that if any one of my children shoul dye before tha marry such estate devised to them shall be sold at twelve months credit by taking bond and aproved security for the securing the purchase money and to be equally divided between my living sons. and daughters when collected.

15th It tis my will and desire to be understood that Elizabeth Archer wife of B.B. Archer has two hundred and forty dollars of my property devised to her in land improvements and c. on Jaw bone run whare of she has now in position out of the intended two hundred and forty dollars while Sarah An Sexton the wife of Wm Sexton and Mary Strader the wife of Valentine Strader and Winford Elenor Miller the wife George W. Miller Prudence Jackson and Rebeckah An has not anything towards thare two hundred and forty dollars and when this amount is received by each of my daughters above named then if thare shall be any more it shall be equity divided between my sd seven daughters if thare should not be a nuf you fall behind a little giving Elizabeth a little the preference.

16th It is my will and desire that Black George be returned to Jacob J. Jackson when I bought him from beleaving the boy coul sea wile finding this not to to be the case.  I ( blank) with J.J. Jackson he did agrea to take him Back.  never tol me.  On what terms I told him in our last conversation to let me no as I intended for him to take him back.  the defraud was two grait for me to pay the price, he could not been give to me if I had none the fact about his eye sight tho I would rather pay one half than to have hard thoughts of J. J. Jackson will not receive him on those terms let George run if the estate can be acquited and not bound for this contract or maintenance and refuse to pay J.J. Jackson anything.  16th  I now notice and _____each devise and loin and Roads ____or inter loines.  I devise 10 loin 1 plow_____interloined I devise 10 loin 1 Ploow raist?16 loin & ___raist in same loine under loin and one for Minter J. Jackson.  I devise 5  loin raist & interloiner? ___Prudence 6 loin interloine bedding household to make them equal to the rest.9.1 ___raist 12.interloined 3 daughters 3. devise 3. loin interloined __10 loines raist 16 words? 4 devise 1 loin raist 4 _4 line interlined 3 beginning eighth line interlined 3rd ninth line interlined Lourentz twenty sicond line interlined with the fence twenty third interlined Keap 2feet from sd fence on the No side 5 devise third line interlined sd I ___6 devise two words in the 4 loin raist.  Sixth line interlined then as _line interlinde line 18line of _devise third line raist 3 words fourth line interlined Except what is devised 5 loin raist 1 word twelth line interlined 3 it shall be raised tenth devise then line interlined and one Cow each 12 devise 1 loin 3 fourth loine interlined one Cast plow to Brake up ground 12 loin raist 3 long? to my wife 13 devise 5 loine interloined 3 shep 13 line__ 3 ive 14 loin 2 words raist 15 devise 4 line interlined on Jaw Bone run 17_ and lastly i apoint my wife Rebeckah Jackson and George W. Miller Executors of this my last will and testament heareby revoking all other heretofore made.  In witness whereof I have hereunto set my hand and seal fifth day of February 1847.  Edward H. The will was probated in Lewis Co., (W)V Court House during the May term and proved by oaths of W.W. Jackson and Jacob J. Jackson.
