But there is excepted from the foregoing grant the inside lot known as the Jackson lot, as now enclosed which is 48 feet in length and 21 feet in width, and also on the north side of said lot and next thereto the lot known as the Stonewall Jackson lot, which is 21 feet long and 8& 1/2 feet wide, the first named lot so excepted have the scites or longer lines there of on the east and west sides thereof and the second having its longer lines on the north and south sites thereof also excepting all side lots heretofore sold by James M. Jackson lying within the above described boundary and this grant is made upon the express conditions that the party of the second part shall forever keep said Cemetery hereby granted enclosed with a substantial fence or wall, at the option of the second part, keep the surface clear of briars, elders etc.

In this deed it is only stated:
The party of the second part covenants and agrees that it will keep the cemetary area herein conveyed enclosed with a substantial fence or wall and will keep the entire lot or parcel clean of weeds, briars, elders, bushes and filth of every kind; and will protect the gravestones or monuments in the cemetery from injury; and so far as possible prevent all other burials in said cemetery.
